Terms
Terms of Use
These are the terms for using The Fern Basket app ("the app"). By using the app you agree to them. If you don't agree, please don't use the app. The app is made by The Fern Basket, a sole trader in New Zealand. You can reach us at support@thefernbasket.com.
What the app does
The app turns recipes you choose — from a link, a video, a photo or text you type — into a shopping list, and helps you shop and cook from it. Ingredient lists, cooking steps, swaps and price estimates are produced by software, including AI, from what you give it. They can be wrong. Always check amounts, ingredients and labels yourself, especially for allergies or dietary needs. The app gives cooking help, not medical, dietary or allergy advice.
Your recipes
The recipes you import stay yours, and you are responsible for having the right to use them. Don't import content you aren't allowed to use. We don't claim any ownership of your recipes, baskets or notes.
Free plan and Premium
The core of the app — importing recipes within a monthly allowance, your basket, quick check, shop mode and cooking steps — is free. Premium adds features such as healthier, lower-calorie, vegetarian, vegan, gluten-free and dairy-free versions of recipes, and removes the monthly import limit. What's free and what's Premium is listed on the Premium screen in the app.
Subscriptions and billing
Premium is a subscription billed by Google Play (on Android) or the App Store (on iPhone) to the account you use there. We never see your card details.
- Price and period. The price and whether it's monthly or yearly are shown on the Premium screen before you buy, in your store's currency.
- Free trial. If a free trial is offered to you, its length and the date of the first charge are shown before you start it. A trial is available once per person.
- Automatic renewal. A subscription renews automatically at the end of each period unless you cancel it, through your Google Play or App Store account, at least 24 hours before the period ends.
- Cancelling. You can cancel at any time in Google Play or the App Store (Settings → Manage subscription in the app takes you there). You keep Premium until the end of the period you've paid for. Deleting your account or the app does not cancel a subscription — cancel it in the store too.
- Refunds. Refunds are handled by Google Play or the App Store under their policies and, in New Zealand, by the Consumer Guarantees Act 1993 where it applies.
- Price changes. If a price changes, the store will tell you before you are charged the new price, and you can cancel.
Your account
You can use the app without an account for most things. Importing recipes and checking prices need a free account, which only takes your email. Keep your sign-in code to yourself. You can export your data and delete your account from Settings → Data & privacy at any time. How to delete it is on Delete your account.
Acceptable use
Please don't try to break, overload, copy or reverse-engineer the app or its service, use it to send abusive content, or use it in a way that breaks the law. We may suspend an account that does.
Availability and changes
We work to keep the app available, but it depends on third-party services (including AI providers, the app stores and supermarket data) and we can't promise it will always work or that every recipe will import. We may change or remove features, and we'll say so in the app's update notes. If we ever stop offering Premium, you won't be charged for periods you can't use.
Liability
To the extent the law allows, we aren't liable for loss that comes from relying on an ingredient list, cooking step, swap or price estimate the app produced, or from the app being unavailable. Nothing in these terms limits rights you have under New Zealand consumer law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, which can't be excluded.
Privacy
How we handle your information is in our Privacy Policy, which forms part of these terms.
Changes to these terms
If we change these terms in a way that matters, we'll show the new version in the app and update the date at the top. Using the app after that means you accept the new terms.
Governing law
These terms are governed by the laws of New Zealand.
